… omne iuditium transferre placuit. II. DE USUCAPIONE. [Paul. Sent. V, 2]
Due to a typographical error, the codex was attributed to the "Leges scriptorium" of Louis the Pious by McKitterick (Carolingians and the Written Word, p. 58) [Paris lat. 4418 was actually meant]. Mordek (Bibliotheca p. 423) mentions the shelfmarks of both codices within his discussion of the "Leges scriptorium", causing Liebs to suggest that the codex came into being in Tours during the 820s/830s. Considering the script (minuscule, layout), a Tours origin is implausible. The usage of notae Tironianae (not mentioned in Hellmann, Tironische Noten) as well as the content, point to the manuscript's creation in a French scriptorium, presumably during the 2nd or 3rd third of the 9th century. Appearing before the text of the Epitome Aegidii is the prologue of the Lex Baiuvariorum, which is a particular case (previously unknown; not mentioned in the MGH edition); the prologue is often transmitted independently from the Bavarian codification. The Roman law of the Epitome is glossed occasionally. [Karl Ubl]
